1. Provider and scope
Provider and contracting parties:
Fabian Kraushofer and Florian Bartl
Acting jointly under the name NETFIGHT
Taborstraße 118/18
1020 Vienna, Austria
Email: support@netfight.at
Telephone: +43 664 304 26 20.
The planned company is referred to as “Netfight FlexKapG in Gründung” (in formation). The contracting parties are currently the two individuals named above, not an already established FlexKapG.
These General Terms and Conditions cover paid NETFIGHT streaming subscriptions for consumers. Individually agreed terms and mandatory consumer rights remain unaffected.
2. What the subscription includes
For its duration, the subscription provides personal access to the published fight videos, tournaments and Fight Nights included in the NETFIGHT subscription, together with the associated account features and watchlist.
“Save” and “Watch Later” refer to a watchlist in the user account, not the purchase of a video file or a permanent offline download. Once paid access ends, there is no entitlement to continue playing subscription-only videos.
An upcoming-event announcement alone does not promise a live broadcast or a recording. Any such commitment is expressly stated in the relevant offer. This clarification does not limit binding commitments about the service.
3. Account and technical requirements
Creating a free account does not start a paid subscription. A paid contract requires the necessary legal capacity or the valid consent of a legal representative.
Account holders must provide accurate information needed to perform the contract and protect their credentials against unauthorised use. Suspected misuse can be reported to support@netfight.at.
Playback uses the internet and requires a suitable device, a sufficient internet connection and a supported browser. Supported browsers, devices, picture quality and any geographical restrictions are specified in the service description available before ordering. Your own internet-access costs are not included. NETFIGHT cannot transfer responsibility to the customer for the unsuitability of technology that NETFIGHT itself has promised to support.
4. Ordering and conclusion of the contract
Before a binding order, the selected plan, its scope, total monthly price, minimum term and cancellation conditions are displayed. Input can be corrected until the binding order is submitted.
By using the order button clearly indicating an obligation to pay, the customer makes an offer to enter into a contract. NETFIGHT accepts it through an express contract confirmation by email. A message identified only as an acknowledgement of receipt is not acceptance.
The contract confirmation includes the agreed plan, contract and service start dates, the end of the initial minimum term, renewal and cancellation conditions, billing dates, these terms and withdrawal information in a form that can be saved. If early performance is requested, it also includes the customer's declarations under section 7.
Paid digital content is provided before the withdrawal period expires only after express consent to early performance, acknowledgement of the associated loss of the right of withdrawal and provision of the contract confirmation on a durable medium. The agreed provision begins once the contract has been concluded, the first payment has succeeded and these conditions have been met. Without the required declarations, performance does not begin early; the normal start date after the withdrawal period is specified before ordering. Creating an account alone does not cause the loss of the right of withdrawal.
5. Prices and payment
| Plan | Total monthly price | Initial minimum term | Total for the minimum term |
|---|---|---|---|
| NETFIGHT 12 months | €5.99 | 12 months | €71.88 |
| NETFIGHT 3 months | €7.99 | 3 months | €23.97 |
| NETFIGHT Flex | €9.99 | 1 billing month | €9.99 |
Payment is collected monthly in advance, not as an immediate payment for the entire twelve- or three-month term. The quoted amounts are final prices. Transactions qualifying for Austria's small-business VAT exemption are exempt under section 6(1)(27) of the Austrian VAT Act 1994; VAT is not shown separately for these transactions. Any taxes applicable to other transactions are included in the final price displayed before ordering. No additional mandatory NETFIGHT fees apply.
A billing month starts on the agreed date on which paid service begins. Subsequent months generally start on the corresponding calendar day or, where that day does not exist, on the last day of the relevant month. Exact billing dates are included in the contract confirmation. Where a later service start is agreed, the paid subscription term also starts on that later date.
Payments are processed through Stripe and the payment methods actually offered during checkout. The payment service provider does not replace NETFIGHT as the contracting party for the streaming subscription. If a payment fails, the customer is notified and given an opportunity to resolve it. Both parties' statutory rights remain unaffected.
An agreed price is not increased during an existing subscription merely by changing the website. Different prices or plans require a valid agreement. Cancellation does not create a blanket right to immediate payment of all future monthly instalments.
6. Duration, automatic renewal and cancellation
The initial term is twelve months for the €5.99 plan and three months for the €7.99 plan. The €9.99 Flex plan remains cancellable monthly. Monthly billing does not give a monthly right to end either fixed-term plan during a validly agreed commitment period.
| Plan | Renewal if not cancelled | Cancellation and additional exit |
|---|---|---|
| NETFIGHT 12 months — €5.99/month | Twelve months at a time at the existing price | One full billing month's notice before the term ends; additional exit at the end of the third month of each renewed year, with the same notice |
| NETFIGHT 3 months — €7.99/month | Three months at a time at the existing price | One full billing month's notice before the relevant term ends |
| NETFIGHT Flex — €9.99/month | Continues month to month at the existing price | At the end of the current billing month; no additional advance-notice period |
Calculating notice: For fixed-term plans, cancellation must reach NETFIGHT no later than the end of the penultimate billing month of the relevant term. This leaves a complete billing month between the cancellation deadline and the term's end. For the additional exit from a renewed annual subscription, the deadline is the end of the second billing month of that renewal year. Specific dates are stated before ordering, in the contract confirmation and in the user account. Mandatory statutory rules for calculating periods remain unaffected.
Additional exit for the annual plan: After each automatic annual renewal, the customer may also terminate at the end of the third billing month of that renewed year. This cancellation can be given immediately after missing the regular deadline; no proof of an oversight or special reason is required. If received on time, the subscription ends after those three months. There is no exit fee and the remaining nine months of that renewal year are not charged. Months already paid are not retrospectively repriced at a higher tariff. If the additional deadline is also missed, the next ordinary termination under this contractual provision is at the end of the current renewal year. Mandatory statutory termination rights are unaffected.
Fixed-term plans renew automatically only if the customer has not cancelled on time and NETFIGHT has properly provided the separate notice described below. The monthly plan price stays the same. The renewal period and final cancellation date are specified before conclusion and in the contract confirmation. A valid cancellation already received is not overridden by a reminder or a technical renewal.
Reminder before renewal: Before each automatic renewal of a fixed-term plan, NETFIGHT undertakes to send a separate email explaining the term's end, automatic renewal if not cancelled, the renewal's duration and price, how to cancel and the exact deadline. The notice must reach the customer by the start of the penultimate billing month of the expiring term, leaving a full billing month to respond. Earlier cancellation for the next available end date remains possible at any time. Without the required timely notice, NETFIGHT will not rely on silence as grounds for automatic renewal.
Additional-exit information: After every valid annual renewal, the customer receives confirmation stating the new year's start, the additional end date after three months and its cancellation deadline. NETFIGHT also sends a separate reminder by the start of the renewed year's second billing month. Customers do not have to wait for this reminder to cancel.
Cancellation is possible by email to support@netfight.at and through a dedicated cancellation feature in the account once available. No reason is required. NETFIGHT confirms receipt and the contract's end date by email. Cancellation does not depend on receipt of that confirmation to be effective.
A cancellation that does not expressly request a later date is recorded for the earliest permissible contract end, including the additional exit in a renewed annual plan. Customers do not need to submit it again simply because an earlier deadline has already passed when it is received.
Paid access remains available until the effective end date. Simply not using the service does not end the subscription. Minimum terms do not restrict statutory withdrawal, warranty or extraordinary termination rights.
Date examples: For a subscription starting on 1 October 2026, the initial annual term ends on 30 September 2027; regular cancellation must arrive by 31 August 2027. Following a valid renewal from 1 October 2027, the additional exit is on 31 December 2027 if cancellation arrives by 30 November 2027. A three-month subscription starting on 1 October 2026 ends on 31 December 2026 if cancelled by 30 November 2026; otherwise, if the renewal conditions are met, it renews until 31 March 2027. The deadline for that next end date is 28 February 2027.
7. Withdrawal
Consumers generally have a fourteen-day right of withdrawal from conclusion of the contract. For paid digital content not supplied on a tangible medium, section 18(1)(11) of the Austrian Distance and Off-Premises Contracts Act (FAGG) allows this right to expire upon early performance only if all of the following conditions have been met:
- The customer has expressly consented to NETFIGHT starting performance before the withdrawal period expires.
- The customer has expressly acknowledged that this early start causes the loss of the right of withdrawal.
- NETFIGHT has provided the legally required contract confirmation, including these declarations, on a durable medium, for example by email.
- The customer-initiated stream of the purchased digital content has subsequently actually begun. Merely enabling an account or providing a link is not sufficient.
Acceptance of the terms alone, registration or payment does not meet these requirements. If the requirements are not met in full, the statutory right of withdrawal remains. On valid withdrawal, payments already received are refunded under the law; no charge for use of this digital content is made and the obligation to pay further subscription instalments ends. Details are set out in the withdrawal information and model withdrawal form below.
This exception concerns digital content. It does not exclude withdrawal rights across the board for any separately agreed services or other supplies. Statutory warranty and other mandatory termination rights remain unaffected.
Ordinary cancellation under section 6 and withdrawal are different rights. The customer need not use a particular legal term if the declaration clearly expresses a wish to withdraw from the contract.
8. Permitted use and content protection
Streaming access is intended for personal, private use. Without separate authorisation, it does not permit commercial exploitation, public screenings, redistribution or sharing protected video access. Uses permitted by law remain unaffected.
Where there is concrete evidence of unauthorised use, NETFIGHT may take necessary and proportionate protective measures. Unless an immediate risk requires urgent action, the affected customer is informed first and given an opportunity to respond. Access is not suspended at NETFIGHT's unfettered discretion, and legitimate customer claims are not excluded.
9. Provision, defects and changes
Statutory warranty rights apply, particularly the Austrian Consumer Warranty Act where applicable. If digital performance is defective, statutory conditions may entitle the customer to have conformity restored, obtain a price reduction or terminate the contract. Required updates are supplied in accordance with statutory duties.
Problems can be reported to support@netfight.at. NETFIGHT aims to resolve them promptly. References to maintenance, internet problems or third-party rights do not exclude statutory claims across the board.
The archive may be expanded. Contractually promised content or features may be restricted only under a valid agreement or to the extent permitted by law. These terms do not create a general right to arbitrarily remove or materially change paid services.
10. Liability
Liability is governed by statutory provisions. These terms do not provide a blanket exclusion or limitation of liability in NETFIGHT's favour.
11. Privacy and Hot Fight News
Personal-data processing must be explained in a separate privacy notice; these terms do not replace that notice. Acceptance of these terms is not blanket consent to advertising or unnecessary data processing.
Signing up for Hot Fight News is voluntary. Newsletter consent is not a condition of creating an account or buying a subscription. Consent can be withdrawn at any time for the future, including through the unsubscribe link in the newsletter.
12. Complaints, applicable law and jurisdiction
Questions and complaints can be sent to support@netfight.at. Any legally required information on alternative dispute resolution will be supplied after checking the provider's applicable duties and any obligation to participate.
Austrian law applies. Consumers retain the mandatory protections of the law of their habitual residence insofar as applicable conflict-of-laws rules provide for them. Statutory jurisdiction rules apply to court proceedings; no exclusive Vienna jurisdiction is agreed for consumers.
Appendix: withdrawal information
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period expires fourteen days after the day on which the contract is concluded.
To exercise the right of withdrawal, you must inform us — Fabian Kraushofer and Florian Bartl, acting jointly under NETFIGHT, Taborstraße 118/18, 1020 Vienna, Austria, telephone: +43 664 304 26 20, email: support@netfight.at — of your decision to withdraw by an unequivocal statement, for example a letter sent by post or an email. You may use the model withdrawal form below, but this is not obligatory.
To meet the deadline, it is sufficient to send your communication concerning withdrawal before the withdrawal period expires.
Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs except additional costs resulting from choosing a delivery method other than our least expensive standard delivery, without undue delay and no later than fourteen days after the day on which we are informed of your decision to withdraw. We will use the same payment method as for the original transaction unless you expressly agree otherwise; you will not incur any fees for the reimbursement.
Exception: early expiry for paid digital content
For digital content not supplied on a tangible medium, your right of withdrawal expires upon the start of streaming initiated by you before the withdrawal period ends only if you previously expressly consented to early performance, acknowledged that it would cause the loss of your right and received the legally required contract confirmation, including your declarations, on a durable medium. Registration, enabling your account or making these declarations alone does not end the right; all conditions, including actual early streaming, must be met.
If they are not all met, you may exercise your existing right as set out above. No charge for use of this digital content is made on valid withdrawal. Your statutory rights regarding defective performance and your cancellation rights remain even where the right of withdrawal has validly expired early.
